By completing this form you are acknowledging the terms & conditions of the National Cannabis Championship as stated in the Official Rules and Guidelines.
By participating in any of the Contests, you agree: [a] to be legally bound by the Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to the Contests; [b] to release, waive, discharge, indemnify, defend and hold harmless Sponsor (High Street, LLC), All Third Parties, and each of their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, shareholders, partnership, members, principals, employees, agents, attorneys, representatives, contractors, subcontractors, customers, or suppliers, and the Judging Panel (as defined in the Official Rules) and any other party associated with the development or administration of the Contests (collectively, “Released Parties”) from any and all injuries, liabilities, losses, claims, causes of actions, damages of any kind, and expenses (including attorneys’ fees) arising out of or related to your acts or omissions (or those of your agents, employees, subcontractors, or customers), your breach of any representations or warranties herein, the cultivation, harvesting, distribution, production, processing, marketing, sale, transfer, marketing, transportation, or use of the Submission (as defined in the Official Rules), your participation in the Contests or your acceptance, use or misuse of any of the Prizes including, without limitation, personal injury, death and property damage, criminal claims or offenses, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy.
By participating or entering any of the Contests, you acknowledge, understand, represent, and warrant as follows: [a] while the cultivation, distribution, sale and possession of cannabis has been authorized under the laws of certain states and the District of Columbia, cannabis remains a Schedule 1 drug under federal law, including the Federal Cannabis Laws (defined below). Notwithstanding the laws of these states and the District of Columbia, the cultivation, harvesting, distribution, production, processing, marketing, sale, transfer, use, and possession of cannabis anywhere in the United States (including these states and the District of Columbia), remain a criminal offense under federal law, punishable by fines and imprisonment; [b] Sponsor cannot give you any assurance that the United States Department of Justice will not enforce federal laws prohibiting the cultivation, distribution, sale or possession of cannabis, even in states (or the District of Columbia) where those activities have been legalized; [c] you may be subject to a federal criminal investigation, prosecution, or action, targeting you or your business, arising out of your participation in the Contests, and you will not hold any of the Released Parties responsible for any such criminal offenses or penalties arising therefrom or related thereto, including, but not limited to, any fines; [d] the activities contemplated by the Contests may be illegal under state law unless each party acts in compliance with applicable state and local law; [e] all Submissions were produced, packaged, and shipped in compliance with all laws, rules, and regulations applicable to Participant, including, but not limited to, state and local laws applicable to Participant; [f] Submissions qualifying as “Industrial Hemp” as such term is defined in the Agricultural Improvement Act of 2018, follow all regulations from the federal, state, and local levels, particularly when transporting Submissions; [g] the Participant will share all products represented by the Submission in strict compliance with all applicable laws; [h] all Submissions submitted to Our Third Parties Partners comply with their Terms and Conditions; [i] all Submissions are safe, stable, homogeneous, and representative of the batch from which it is taken, and will not pose a risk to the health, safety, or welfare of the public; and [j] the Official Rules’ invalidity for public policy reasons and/or its violation of Federal Cannabis Laws (defined below) is not a valid defense to any dispute or claim arising out of these Official Rules, including any of the Contests or the Prizes, and you expressly waive the right to present any defense related to the federal illegality of cannabis and agree that such defense shall not be asserted, and will not apply, in any dispute or claim arising out of these Official Rules.
“Federal Cannabis Law” means any U.S. federal law, civil, criminal, or otherwise, that is directly or indirectly related to the cultivation, harvesting, production, processing, marketing, distribution, sale, transfer, possession, and use of cannabis, marijuana, or related substances or products containing cannabis, marijuana, or related substances, including without limitation the prohibition on drug trafficking under the Controlled Substances Act (21 U.S.C. § 801, et seq.), the conspiracy statute under 18 U.S.C. § 846, the bar against aiding and abetting the conduct of an offense under 18 U.S.C. § 2, the bar against misprision of a felony (concealing another’s felonious conduct) under 18 U.S.C. § 4, the bar against being an accessory after the fact to criminal conduct under 18 U.S.C. § 3, and federal money laundering statutes under 18 U.S.C. §§ 1956, 1957 and 1960.
BY ENTERING ANY OF THE CONTESTS, YOU ACKNOWLEDGE AND ASSUME THE RISK THAT YOU (AND YOUR BUSINESS) MAY BE INVESTIGATED AND/OR PROSECUTED FOR VIOLATING FEDERAL CANNABIS LAW. IF YOU DO NOT WANT TO ASSUME THIS RISK, YOU SHOULD NOT ENTER OR OTHERWISE PARTICIPATE IN ANY OF THE CONTESTS.
